Information: Japan Enacts Regulatory Law that targets Apple as well as Google Smartphone Marketplace Dominance -

Jul 4, 2024

Japan is the latest nation to enact laws that target firms like Apple Inc. and as Google LLC from limiting third-party firms that are trying to sell and distribute their own applications on Google and Apple devices.

In the words of Kyodo News, "The laws will prohibit the creators of the iPhone's iOS as well as Google's Android smartphones operating systems, storefronts for apps and payment platforms from preventing the selling of software or services that compete directly with native platform's." The aim is to keep the providers of platforms from being in "gatekeeping" as well as ensuring more competition between their own apps as well as other applications available on platforms.

The current Japan antimonopoly law penalizes 6 percent of the revenue generated by unlawful practices. The sanctions under this law are 20% on domestic revenues earned from services that are violating this law, increasing up to 30% if problematic practices are not discontinued.

The law is anticipated to be in effect in 2025 and, according to Kyodo News points out is identical to the most recent EU rules (presumably this is similar to the European Union's Digital Markets Act).

Kyodo News also reports that both Apple and Google have issued announcements about their continued engagement in partnership in partnership with Japanese regulators.

A previous article on Kyodo News regarding the regulation which was passed first by Japan's Cabinet declared that they was a vote to approve the legislation as "a measure to challenge the duopoly exerted by two giants of the industry Apple Inc. and Google LLC," and that the regulation reflects the Japanese government's desire to be a part to the EU in enacting additional legislation "of Big Tech firms such as Apple, Google and Amazon.com Inc. which have managed to play a major role on digital services across the globe."
